By allowing a certain stylistic simplification, one could argue that organic constitutionalism is a consequence and a prerequisite of any refined capitalism. And if this is true, it becomes clearer why in organic constitutionalism freedom precedes democracy and is not its product. Indeed, in the historical sense freedom is a genetic condition of people’s rights. True democracy can only exist in a community of politically equal and free subjects. On the other hand, democracy has the ability to limit or even completely destroy freedom. Therefore, in organic constitutionalism freedom, not democracy, is the preferred object of protection and security. In a certain sense, organic constitutionalism is “anti-law” or informality embodied in law.
